What was announced
On June 5, 2026, the Massachusetts Attorney General's Office announced settlements with Flexible Fundamentals, Inc., a former Whitinsville ABA provider, and its two co-owners. The settlements also bind two new companies, one run by each co-owner. The agreements require payment of up to $778,703 to the Commonwealth, as one combined total. The release's headline says up to $770,000 and its body says $778,703. We use the body figure.
What the office alleged
The office alleged that the company billed MassHealth, through its managed care entities, for ABA services that were never provided or were not properly documented; billed for more hours than it provided; and failed to supervise its paraprofessional behavioral technicians, submitting claims for technician services without the required supervision by Licensed Applied Behavior Analysts. The office described these as allegations, not findings of wrongdoing.
What the settlements require
The agreements require three years of compliance and monitoring programs and additional staff training, with independent compliance monitors conducting annual on site audits.
Why it matters to an operator
Analysis: The three allegations, services not delivered, hours billed above hours provided, and technician work without required supervision, are the same patterns a records audit looks for. A clinic that can match each billed unit to a session note and a supervision record can answer all three. Our Federal auditors dossier tracks the audit side of this.
If a records audit reached your practice, the compliance audit assesses your documentation and structure before anyone asks, with a prioritized fix list, alongside your counsel. If you have already received an audit or records request, call your counsel first.
